Nelson Havi links Judge Josephine Mong’are and husband to bribery saga

Justice Josephine Mong’are has found herself at the centre of a public debate after claims shared online by lawyer Nelson Havi raised questions about an alleged bribery scheme linked to a court case.

The discussion began after Havi posted details on his Facebook page about the arrest of Kennedy Mulwa and former judge Joseph Mutava, an incident that has continued to attract attention within Kenya’s legal circles.

In his post, Havi alleged that Mulwa and Mutava were arrested while soliciting a bribe on behalf of Justice Mong’are. He claimed the two were caught in an operation conducted by officers from the Ethics and Anti-Corruption Commission (EACC).

According to Havi, investigators found that Mulwa had been in phone communication with the judge shortly before the arrest took place.

Havi further stated that Kennedy Mulwa is the spouse of Justice Mong’are. He added that phone records reportedly reviewed by investigators showed contact between them minutes before the arrest. The former Law Society of Kenya president said the information had been verified by the EACC, though these claims have not been publicly confirmed through official findings presented in court.

The allegations relate to a corruption case in which Mutava and others were accused of demanding a bribe of about 10 million Kenyan shillings. The money was allegedly meant to influence the outcome of a commercial dispute that was before Justice Mong’are.

Some reports mentioned businessman and politician Raphael Tuju as the person from whom the money was allegedly being sought.

The arrest of Mutava and Mulwa was reportedly carried out during what appeared to be a planned operation by anti-corruption investigators.

After their arrest, the suspects were later released on cash bail as investigations continued.

Mulwa’s alleged connection to the judge has drawn strong public interest. If the claim that he is her spouse is finally mentioned in court, it would raise questions about how personal relationships might intersect with matters before the courts.

Justice Mong’are has also responded through legal action. The High Court issued temporary orders stopping the EACC from summoning, arresting, or investigating her while her application challenging the probe is being considered.

The orders are meant to allow the court to examine the matter carefully before further steps are taken.

Legal experts say such orders are not unusual when judges argue that investigations could interfere with judicial independence. The principle of judicial independence is meant to protect judges from pressure while performing their duties.

However, it must also be balanced with the need to investigate corruption allegations when they arise.

The situation has renewed discussion about integrity within Kenya’s judiciary. The courts play a critical role in resolving disputes and protecting rights, and allegations involving judges can affect public confidence in the system.

Havi is known for speaking openly on issues affecting the legal profession and governance. Through his law practice and public commentary, he has often addressed matters related to accountability in public institutions.
