Small businesses hit hard by CA’s 0.4% annual turnover fee for new TED license

The Communications Authority of Kenya (CA) is planning to introduce a new Telecommunication Equipment Distributor (TED) license.

This move aims to combat the spread of counterfeit electronic devices in the country. Electronic wholesalers and telecommunications companies will be directly affected by this new regulation.

Under the proposed licensing scheme, distributors will need to pay a one-time fee of KSh 250,000 for a license valid for 15 years.

Additionally, they will be required to pay annual fees amounting to 0.4% of their annual turnover, with a minimum payment of KSh 120,000.

This means that even smaller distributors will face a big financial obligation to comply with the new regulations.

The CA’s initiative is part of a broader effort to address the challenges posed by counterfeit electronic devices in Kenya.

Counterfeit electronics not only undermine genuine businesses but also pose safety risks to consumers.

The Anti-Counterfeit Act, established to prohibit trade in counterfeit goods, underscores the government’s commitment to tackling this issue.

Implementing the TED license is expected to have several implications for electronic wholesalers and telecommunications companies.

The proposed TED license is a continuation of these efforts, aiming to regulate the distribution channels of electronic devices more effectively.

By imposing licensing requirements, the CA seeks to ensure that only authorized distributors operate within the market, thereby reducing the influx of counterfeit products.

Electronic wholesalers and telecommunications companies will need to prepare for the upcoming changes by evaluating their current operations and ensuring compliance with the new licensing requirements.

This may involve auditing their supply chains, establishing direct relationships with manufacturers, and implementing internal measures to verify product authenticity.
