92-Year-Old Samuel Kimiti Ndoro sentenced to life in Prison for defiling 10-year-old child

A 92-year-old man has been sentenced to life imprisonment after he was found guilty of defiling a 10-year-old child in Mukurwe-ini, Nyeri County.

Samuel Kimiti Ndoro was handed the sentence on September 10, 2026, by Principal Magistrate Agde Savai Eddah at the Mukurwe-ini Law Courts.

The court found him guilty of defilement under Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006.Ndoro had also faced an alternative charge of committing an indecent act with a child under Section 11(1) of the same law.

However, the court ultimately convicted him on the main charge after the prosecution presented evidence linking him to the offence.

The prosecution was led by Principal Prosecution Counsel Elizabeth Waruguru and Prosecution Counsel Sarah Kitui. They told the court that Ndoro knew the child and was a family friend.

According to the evidence presented, Ndoro took the child to a secluded part of his compound, where he sexually assaulted her.

After the incident, he reportedly gave the child money and warned her not to tell anyone what had happened.

The matter later came to light after Ndoro became concerned that the child might disclose the incident to her grandmother. He reported the child to her grandmother, claiming that she had stolen money from him.The grandmother then questioned the child about the money that was in her possession.

During the conversation, the child disclosed that the money had been given to her by Ndoro after the assault.

The child also told her grandmother about an earlier incident in which she said Ndoro had defiled her.

The prosecution called five witnesses during the trial and presented medical and other evidence to support its case. Among the evidence presented in court was the balance of the money that Ndoro had allegedly given the child.

The court heard that the child had already spent part of the money before the matter was reported.

After considering the evidence, the court found the child’s testimony credible and sufficiently supported by other evidence presented by the prosecution.

The court also found that the child had positively identified Ndoro as the person who assaulted her.

Ndoro’s defence was also rejected by the court. The magistrate noted inconsistencies in his account and found that his evidence did not create reasonable doubt in the prosecution’s case.

The court therefore found Ndoro guilty of defilement and sentenced him to life imprisonment.

The sentence will take effect from the date Ndoro was first arraigned and detained, meaning the period he has already spent in custody will be taken into account.

The case was prosecuted by the Office of the Director of Public Prosecutions, which secured the conviction after presenting witness, medical and other supporting evidence before the court.
