The Teachers Service Commission (TSC) has announced the revocation of 33 teachers’ appointments across the country.
In a February 5 Gazette notice, TSC Chief Executive Officer Nancy Macharia stated that the decision was made in compliance with the authority conferred by Section 30(2) of the Teachers Service Commission Act.
“In exercise of powers conferred by section 30(1)(e) of the Teachers Service Commission Act, Chapter 212 of the Laws of Kenya, the Commission wishes to notify the public that the persons whose names are specified in the Schedule herein below have been removed from the Register of Teachers pursuant to the provisions of section 30(2) of the Teachers Service Commission Act,” the Gazette notice read.
According to the Act, anyone who is deregistered is no longer considered a teacher and is prohibited from providing teaching services in any capacity, whether in a private or public schools
After giving an extensive list of teachers whose services had been canceled, the Gazette notification stated that the people were deregistered from the TSC on January 7, 2025.TSC clarified in the same Gazette announcement that the teachers had been deregistered as a result of the disciplinary process, implying that the named persons may have committed professional violations.
Section 30 of the TSC Act states that a teacher may be removed from the register for a variety of reasons, the most common of which is misconduct.
The TSC can deregister a tutor for a variety of reasons, including fraudulent registration, conviction of a sexual offence, conviction of a criminal offence, and physical or mental disease that renders the teacher unable to execute obligations.
School principals have since been warned against hiring anyone who are not registered with the TSC in any capacity, as they face a punishment of at least KSh100,000 or two years in prison.
“Further to the provisions of the TSC Act, Regulation 18(1)(c) and (d) of the Code of Regulations for Teachers, as read together with Section 45 of the TSC Act, states that any person who is not a registered teacher under the Act and engages in teaching or assists in teaching at any school is in violation of the law,” the notice added.
This is the most recent wave of TSC deregistration, occurring just months after another 33 teachers were dismissed from the commission in August 2024.Months prior, the TSC deregistered 65 teachers for disciplinary reasons but did not disclose the infractions.
