Removal of Deputy President Rigathi Gachagua by Impeachment

The process for impeaching a Deputy President Rigathi Gachagua is outlined to ensure both accountability and procedural fairness. Initiating the process requires a motion in the National Assembly, supported by at least one-third of its members. Grounds for impeachment must be significant, including violations of the Constitution or other laws, serious criminal acts, or gross misconduct.

If the motion receives the required two-thirds support from the Assembly, the Speaker must promptly inform the Speaker of the Senate, all within a specified timeframe. The Senate is then required to organize a meeting to discuss the charges within seven days. To ensure a thorough examination of the allegations, the Senate can establish a special committee of eleven members to investigate. This committee has a ten-day period to determine the validity of the accusations, during which the Deputy President is entitled to present a defense.

If the committee concludes that the allegations are unsubstantiated, the impeachment process is terminated. Conversely, if the allegations are found to be substantiated, the Senate will proceed to vote on the impeachment charges. A two-thirds majority vote is required for the Deputy President to be removed from office. This procedural safeguard ensures that the removal of a Deputy President is reserved for cases of serious and proven misconduct, maintaining a balance between stability and accountability.

We Will Impeach DP Rigathi Gachagua Before the End of 2024

A group of Kenya Kwanza legislators have suggested sponsoring an impeachment motion against Deputy President Rigathi Gachagua over accusations of undermining Ruto’s administration. Kimilili Member of Parliament, Didmus Barasa, who was elected on a UDA party ticket, now claims that they will impeach Deputy President Rigathi Gachagua before the end of the year. Speaking on Saturday, September 21, Barasa stated that they were inspired by the Gen Z protests and intended to use the impeachment to fight tribalism.

“We will impeach Deputy President Rigathi Gachagua before the end of 2024. Gachagua will celebrate Christmas as an ordinary citizen,” Barasa declared.

“President Ruto has nothing to do with the impeachment of Rigathi Gachagua. Leaders from Mt. Kenya and across Kenya have decided to impeach the deputy president,” he told K24 TV on Monday.  Nyabari Chache Member of Parliament Zaheer Jhanda asks that President William Ruto be distanced from the rising impeachment discussions against his deputy Rigathi Gachagua.

Cleophas Malala former secretary general of the United Democratic Alliance (UDA) party, on Sunday urged the President to prevent the alleged impeachment plan, warning it could also have repercussions on him.

“I am not qualified to advise, but those you are considering to use to oust your deputy who supported you, you might think you are impeaching Rigathi Gachagua, but you have begun the journey of removing yourself,” Malala said.

During the church service on , Gachagua cautioned Ruto that if the United Democratic Alliance (UDA) party is not organised, then he risks losing the
trust of the Mt. Kenya people, and nothing can save the situation. Addressing the impeachment rumours, Gachagua remarked that it was not within his power to
prevent such attempts and that he was not interested in bribing legislators. “I want to urge President Ruto to put his house in order and allow us to
work. We have a mandate to fulfil to the Kenyan people; we need to get down to work,” he noted.

“It’s up to our boss (President Ruto) to decide what should be done because he is our party leader. He can call a PG and bring down the political temperatures; tell the Members of Parliament to stop attacking each other, ask those who accompany him who abuse the Deputy President to stop…because if he told them to stop, they would stop. Ask them to stop these night meetings…it’s really him to provide leadership so that the country can go back to work,” he said.
