A Nairobi court has approved the extradition of three Kenyan men to the United States after allowing an application filed by the Director of Public Prosecutions (DPP).
The decision clears the way for the suspects to face criminal charges before a U.S. court.
Principal Magistrate Hon. P.K. Mutai endorsed warrants of arrest against Francis Asanyo, Peter Omari and Elvis Obaigwa. The warrants were originally issued by the U.S. District Court for the Eastern District of Virginia, Richmond Division, on November 15, 2023.
The three men are wanted in the United States over several alleged offences. The charges include conspiracy to commit computer intrusions, conspiracy to commit wire fraud, aggravated identity theft, and aiding and abetting under U.S. law.
The extradition process began after the United States submitted a formal request to the Kenyan government on February 26, 2026. The request was sent through Kenya’s Central Authority, which operates under the Office of the Attorney General and Department of Justice.
The application was presented by Jeffrey M. Olson, the Associate Director of the Office of International Affairs in the Criminal Division of the U.S. Department of Justice.
The request included documents and evidence supporting the extradition of the three suspects.After reviewing the request and the materials presented, the Office of the Director of Public Prosecutions confirmed that the legal requirements for extradition under Kenyan law had been satisfied.
The DPP then moved to court seeking orders to allow the suspects to be surrendered to U.S. authorities.
Following the court’s decision, Francis Asanyo, Peter Omari and Elvis Obaigwa were ordered to be held at Industrial Area Prison as they await the completion of the extradition process to the United States.
The prosecution team in the case was led by Senior Deputy Director of Public Prosecutions Vincent Monda. He was assisted by Principal Prosecution Counsel Victor Owiti and Prosecution Counsel Fatma Shaban during the proceedings.
The ruling marks an important step in the cooperation between Kenya and the United States in handling cross-border criminal investigations.
Once the extradition process is completed, the three suspects will be transferred to the United States, where they are expected to answer to the charges before the relevant court.
