Robert Burale loses bid to pull down ex-wife’s YouTube video in defamation case

The legal fight between Pastor Robert Burale and his ex-wife Rozina Mwakideu has taken a new turn after a Nairobi court dismissed his request to have a controversial YouTube interview pulled down.

The case, which has attracted widespread attention online, stems from an interview posted on October 4 on a YouTube channel owned by Rozina’s brother, Alex Mwakideu.

The video, titled “My Biggest Mistake Was Marrying Robert Burale,” has gained massive traction, reaching more than 815,000 views in just a few weeks.

Burale moved to court claiming that the video was defamatory and intended to damage his reputation.

In his suit, he sought Ksh.20 million in compensation from both Rozina and Alex, arguing that the content portrayed him negatively and had caused emotional distress and public embarrassment.

He also wanted the court to compel the two to delete the video from all social media platforms and stop any further distribution.

However, Milimani Commercial Chief Magistrate Thomas Nzyoki ruled that while the court would issue temporary orders to prevent further publication or sharing of the interview, it would not compel the Mwakideus to take down the video already uploaded.

The magistrate made it clear that his decision was meant to balance both parties’ rights as the case proceeds, allowing the matter to be heard fully before any permanent decision is made.

In his ruling, Magistrate Nzyoki stated that the order only applies to future publications and does not interfere with content already online.

He said, “An order for interim injunction is granted to stay the defendants from any further publication of the complained video on any social media platform pending the hearing and determination of the application.”

This means the video will remain accessible to the public until the court makes a final ruling.

The decision comes as a setback for Burale, who had hoped the court would act swiftly to remove the content he considers harmful.

The preacher, who is also a motivational speaker, has faced intense public scrutiny since the interview went viral.

Many online users have shared mixed reactions, with some supporting Rozina’s openness while others believe the matter should have been handled privately.

Lawyer Ochiel Dudley, who represents Alex and Rozina, told the court that his clients would abide by the interim orders and refrain from making any further publications about the disputed video.

The magistrate scheduled the case for mention on February 25, 2026, to confirm that all submissions had been filed.
